We only use personal information to facilitate management and use of the website, including conducting sales transactions and understanding website activity; to contact you in relation to purchases you have made or in response to correspondence we may receive from you; and to contact you through our mailing list if you subscribe to our mailing list. The Website does not engage in third-party advertising or marketing, and we never sell or rent your personal information.

This Privacy Policy describes the terms of our commitment to your privacy, including how your personal information is collected, used, and shared when you visit or make a purchase from www.littlewren.farm (the “Website”).  Acceptance of the terms of this Privacy Policy is a portion of the consideration required for your right to visit and use the website. If you do not accept these terms, you should not use the Website. This Privacy Policy is subject to change without notice.  By accessing the Website you agree to the terms and conditions of the Little Wren Farm Privacy Policy in effect at the time of use and to the Little Wren Farm Terms and Conditions in effect at the time of use.

Please note that this Privacy Policy does not govern the collection and use of information by third parties or by other entities or individuals not employed or managed by Little Wren Farm.

This Privacy Policy is intended to cover all visitors to the Website, all subscribers to lists or newsletters whether paid or unpaid, all members or affiliates whether paid or unpaid, and all customers. Persons or entities who visit or view the Website, whether intentionally or unintentionally, whether solicited or unsolicited, are described herein as “Visitors” and “you” and are parties to this Privacy Policy.  Anyone who orders, attempts to order, or receives a product sold or advertised on or delivered from the Website, even at no cost, is called a “Customer” herein and is subject to this Privacy Policy not only by passive acceptance, but by virtue of the Terms and Conditions. The Website, its agents, owners, operators, employees and affiliates are referred to collectively herein as “Little Wren Farm,” “Website,” “Site,” “Seller,” “we,” “us” and/or “our”.

In the event that a person or entity excluded from use of the Website because of the Terms and Conditions or from denial of service, nonetheless accesses or uses the Website, that person remains subject to the terms of this Privacy Policy and Terms and Conditions.

 

WHAT PERSONAL INFORMATION DO WE COLLECT?

This website collects personal information in the ways described below.

When you visit the Website, we automatically collect certain information about your device, including information about your web browser, IP address, operating system type, application data, time zone, dates/times you accessed the Website, country, and some of the cookies that are installed on your device. Additionally, as you browse the Website, we collect information about actions you take when using the Website, including the individual web pages or products that you view, what websites or search terms referred you to the Website, outbound link clicks, and information about how you interact with the Website. We refer to this information as “Device Information.”

When you visit the Website’s store, we collect certain information that may including:

  • Products you’ve viewed (we may use this to, for example, show you products you’ve recently viewed);
  • Location, IP address and browser type (we’ll use this for purposes like estimating taxes and shipping);
  • Shipping address (if you request a shipping estimate before you place an order, we’ll ask you to enter this information so we can provide an estimate); and
  • Contact information (if you are shopping for an item that is out of stock, and request that we notify you when it is back in stock, we will collect your name and email address so that we can provide the requested notification).

When you make a purchase or attempt to make a purchase through the Website store, we collect certain information from you, including your name, billing address, shipping address, credit card/payment details, email address, and phone number, and information about your purchase including the product, value, and quantity purchased.  We refer to this information as “Order Information.” This information is used to deliver products and requested product information; it is not used for general solicitation purposes.

Online ordering via SSL encrypted communication provided by shopping cart services supporting merchant service companies like Visa and Master Card provides information to the Website, but does not provide complete credit card numbers.

If you create an account, we will store your name, address, email and phone number.  This information will be used to populate the checkout for future orders.

When you leave a comment or review through the Website, the data shown in the comments form is collected, and also your IP address and browser user agent string to help spam detection. We call this “Comment Form Information”.

When you subscribe to our mailing list (also referred to as our “newsletter”, “honey updates”, and “apiary updates”) and/or send us a correspondence, we collect the information you provide to us, including your email address and the content of your correspondence.  We call this “Correspondence Information”.

 

HOW DO WE USE PERSONAL INFORMATION?

We use the Device Information that we collect to help us operate and maintain the website, monitor and screen for potential risk and fraud, understand use of the Website, and to improve and optimize the Website.

We use the Order Information that we collect to fulfill orders placed through the Website (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use Order Information to:

  • Communicate with you, including responding to your comments and requests;
  • Send you information and updates pertaining to your order or request;
  • Provide you with user support;
  • Screen our orders for potential risk or fraud;
  • Protect, investigate, and deter unauthorized or illegal activity;
  • Improve our product offerings;
  • Comply with legal obligations, such as calculating taxes; and
  • When in line with the preferences you have shared with us, provide you with information relating to our products or services.

If you create an account, we will use your stored name, address, email and phone number to populate the checkout for future orders.

We use Comment Form Information to collect and post your comments and product reviews to the Website. Reviews you submit to us may be posted anywhere on the Website or on Little Wren Farm’s social media.

We use Correspondence Information you submit to us to communicate with you (if you have opted in to our mailing list) and to respond to your communications and document our responses. You may unsubscribe from our mailing list at any time by clicking the “Unsubscribe” link at the bottom of our emails. Little Wren Farm will never add your email address to any mailing or marketing lists unless you have opted into those yourself.

 

SHARING PERSONAL INFORMATION

The Website may use third-party service providers to service various aspects of the Website (e.g., sales transactions).  Each third-party service provider’s use of personal information is dictated by their respective privacy policies.  We have limited our sharing of information with third parties to the minimum we feel is necessary to provide our services (e.g., to facilitate sales transactions, maintain a secure and efficiently operating website, and correspond with our mailing list).  The Website currently uses the following third-party service providers which may collect personal information:

We use Automattic to support several functions of the Website including security, ecommerce, and Website statistics.  Third-party services provided by Automattic include Jetpack; WooCommerce, including WooCommerce Shipping & Tax, WooCommerce USPS Shipping, and WooCommerce Payments; and WordPress.com Stats.

Jetpack Protect helps protect against attacks against the Website; they collect a Visitor’s IP address, username/email (if attempting to log in), and IP-related HTTP headers attached to the Visitor, and they track failed login attempts.

WooCommerce, including WooCommerce Shipping & Tax and WooCommerce USPS Shipping, powers our online store, including shipping, tax and check-out elements. To do this, they collect and process Order Information, as described above in this document, and product information (e.g., dimensions, weight, value, quantity). They provide Order Information to the payment processor, Paypal (see additional information about PayPal elsewhere in this section). For calculating taxes they send Order Information to TaxJar. Please see TaxJar’s Privacy Policy for details about how they handle this information. For shipping rates and labels they send Order Information to the carrier directly or via EasyPost. Please see EasyPost’s Privacy Policy for details about how they handle this information.  WooCommerce also stores the purchased shipping labels on their server to make it easy to reprint them and handle support requests.

WooCommerce Payments processes order payments.  WooCommerce Payments partners with Stripe to provide this service. When processing payments, some of your data will be passed to Stripe, including information required to process or support the payment, such as the purchase total and billing information.  We do not have access to financial information you may have on file with Stripe.  Please see Stripe’s Privacy Policy for more details.

WooCommerce Paypal Payments processes Paypal order payments.  WooCommerce Paypal Payments partners with Paypal to provide this service. When processing payments, some of your data will be passed to Paypal, including information required to process or support the payment, such as the purchase total and billing information.  We do not have access to financial information you may have on file with Paypal.  Please see Paypal’s Privacy Statement for more details.

WordPress.com Stats collects Device Information and provides statistics regarding use of the Website, including post and page views, outbound link clicks, referring URLs and search engine terms, and country.  The Website does not have access to any personally identifying information through this feature. Stats logs containing visitor IP addresses and WordPress.com usernames (only for users who log in with a WordPress.com username) are retained by Automattic for 28 days and are used only for the purpose of powering this feature.

As described above, WooCommerce Payments partners with Stripe to help process your order payment.  When processing payments, some of your data will be passed to Stripe, including information required to process or support the payment, such as the purchase total and billing information.  We do not have access to financial information you may have on file with Stripe.  Please see Stripe’s Privacy Policy for more details.

As described above, WooCommerce Paypal Payments partners with Paypal to help process Paypal order payments.  When processing Paypal payments, some of your data will be passed to Paypal, including information required to process or support the payment, such as the purchase total and billing information.  We do not have access to financial information you may have on file with Paypal.  Please see Paypal’s Privacy Statement for more details.

We use Mailchimp to maintain and administer our mailing list and manage communications with our mailing list.  Please see the Mailchimp Privacy Policy for details regarding their privacy policy.  Please note that when you unsubscribe from a mailing list managed by Mailchimp, your information remains on the list of past subscribers.  This measure is intended to prevent you from being unintentionally re-added to a mailing list from which you have unsubscribed.

Mailchimp uses Google reCAPTCHA to tell humans and computers apart so bots can’t fill out forms maliciously on behalf of a human. The CAPTCHA acronym stands for “Completely Automated Public Turing test to tell Computers and Humans Apart.”  Mailchimp uses reCAPTCHA to help prevent bots from adding fake or malicious email addresses to our mailing list.  This may be done using both Invisible and Checkbox reCAPTCHA.  reCAPTCHA works by collecting hardware and software information, such as device and application data and the results of integrity checks, and sending that data to Google for analysis.  Visitors’ use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service.

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

This list may be amended from time to time at the website’s sole discretion.

 

LEGAL BASES for processing personal information

The Website’s use of personal information is based on one or more of the following processing conditions:

  • We have a responsibility to you under applicable terms of service or other agreement with you that requires processing your personal information (e.g., to facilitate a purchase you may make);
  • We have a legitimate interest in using your personal information (e.g., to improve and secure our site, to provide effective delivery of information and products to you, to communicate with you);
  • We have your consent to do so;

DATA RETENTION

We generally store collected data for as long as we may need the information for the purposes for which we collect or use it, for business-related future reference, and/or until we are no longer legally required to continue to keep it.

We store Order Information for up to 10 years for tax and accounting purposes.  (As noted above, we do not have access to your credit card information.)

We store Comment Form Information, including comments or reviews, and their metadata, indefinitely for our records and for promoting our products (as applicable).

We store Correspondence Information, including contact information and correspondences, indefinitely or until a user unsubscribes or requests that we delete their information from our systems. If you choose to unsubscribe from a mailing list, we may keep certain limited information about you so that we may honor your request to remain unsubscribed.

 

ADVERTISING & marketing

This website never uses third-party advertising companies and never engages in remarketing efforts with third-party companies in order to market this website. The website does not engage in affiliate marketing.  This Website does not use your Personal Information to provide you with targeted advertisements or marketing communications. 

 

ANALYTICS

As described above, “WordPress.com Stats” collects Device Information and provides statistics regarding use of the Website, including post and page views, outbound link clicks, referring URLs and search engine terms, and country.  Any piece of data explicitly identifying a specific Visitor is not visible to Little Wren Farm; the Website does not have access to any personally identifying information through this feature.

 

DO NOT TRACK

The Website does not alter its data collection and use practices when it sees a Do Not Track signal from your browser.

 

YOUR RIGHTS

We will take reasonable steps to accurately record the personal information that you provide to us.  You may request to receive an exported file of the personal information we have about you by submitting a request via the contact information provided at the end of this document.  You may also contact us to request that we amend or update your personal information and, in certain situations, you may also request that we erase personal information we hold about you.  This does not include data we are obliged to keep for administrative, legal, or security purposes. We may need to retain certain information for recordkeeping purposes or to complete transactions, or when required by law.

If you contact us with this request, we will ask you to verify your identity and to provide other details before we are able to provide you with information, correct inaccuracies, or delete information. Your right to review, update, correct, and delete your personal information may be limited, subject to the law or your jurisdiction (i) if your requests are abusive or unreasonably excessive, (ii) where the rights or safety of another person or persons would be encroached upon, (iii) if the information or material you request relates to existing or anticipated legal proceedings between you and us, or providing access to you would prejudice negotiations between us or an investigation of possible unlawful activity, or (iv) we are otherwise legally required to maintain your information. Upon request of deletion we will take action and provide you information on the action taken within 30 days.

Notice to California Customers Regarding your California Privacy Rights

California’s “Shine the Light” law regulates businesses that disclose the personal information of customers to third parties for direct marketing purposes.  Little Wren Farm does not disclose the personal information of customers to third parties for direct marketing purposes.

The California Online Privacy Protection Act (CalOPPA) requires commercial websites and online services to post a Privacy Policy and requires privacy disclosures regarding tracking of online visits.  It is the intent of Little Wren Farm to comply with the CalOPPA.  Various provisions of this Privacy Policy address the requirements of the CalOPPA.

The California Consumer Privacy Act (CCPA) provides California residents the right to access and delete personal information. It also provides the right to opt out (and for children, the right to opt in) from the sale of personal information by businesses to third-parties. Little Wren Farm does not sell personal information to third parties.

California residents may request to review and request changes to their personally identifiable information collected by Little Wren Farm by contacting us at the email address provided below.

General Data Protection Regulation (GDPR)

GDPR is a European Union (EU) law that gives its citizens control over their personal data.  Little Wren Farm support the intent of the GDPR, which is designed to keep the ownership of personal data within the control of individuals. The GDPR provides European residents with rights in regards to personal data, including the right to request access, request correction, and request full erasure of personal data.

If you are a European resident, you have the right to request a copy of personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.  Please note, the GDPR provides for some exceptions to this and this does not include erasure of records that we may be required to retain for legal obligations or establishing legal claims.

We do not ship outside of the U.S. so do not anticipate sales to European residents; however, in compliance with the GDPR, we note that if you are a European resident your information will be transferred outside of Europe, including to Canada and the United States.

The website is hosted by DreamHost, a GDPR-compliant hosting service.

 

Sensitive Personal Information

At no time should you submit sensitive personal information to the Website (e.g., social security number, health information).  If you submit such information to us, it will be subject to this Privacy Policy.

 

Children’s Information

Children’s privacy is important to Little Wren Farm. If you are under 18, you may use the Website with the consent and involvement of a parent or guardian. We do not knowingly collect personal information from children without the consent of the child’s parent or guardian.  If a parent or guardian believes that the Website has personally identifiable information of a child, please contact Little Wren Farm via the contact information provided at the bottom of this document and we will use our best efforts to promptly remove such information from our records.

 

DATA PROTECTION & SECURITY

Little Wren Farm does not share your data other than as described in this Privacy Policy. We, or our third-party service providers, may be located outside of your home country; by using the Website, you consent to the transfer of such information to them.

Little Wren Farm will not rent or sell your personal information.

Other than to provide services as described in this document, Little Wren Farm does not disclose personal information except in response to a subpoena, court order or other governmental request, or when Little Wren Farm believes in good faith that disclosure is reasonably necessary to protect the property or rights of Little Wren Farm, third parties or the public at large.

Your data is also protected by our SSL Certificate. While we take measures, including use of encrypted connections, to protect against the unauthorized access, use, loss, alteration, disclosure or destruction of personal information, we do not warranty that outside parties will not breach our system and thus gain access to personal information.  Visitors agree that the Website is not responsible for damages to Visitors resulting from inappropriate use of the site by others and waive all claims of any nature against the Website concerning the loss, alteration, or misuse of Personal Information.

In the event that Little Wren Farm becomes aware of a data breach that may have affected personal information and that is likely to result in a high risk to the rights and freedoms of individuals, we will share information about the nature and magnitude of the breach with affected Visitors for whom we have current contact information.  We will attempt to reach you via email within 72 hours and attempt to update you throughout the process.

We may update this Privacy Policy from time to time and without notice in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.  All modifications are in full force and effect immediately upon posting on the Website, and the modifications replace any prior version of the Privacy Policy.  Little Wren Farm will announce modifications with a Revised Date stated on the Privacy Policy.  Visitors agree to refer to the Revised Date stated on the Privacy Policy to note modifications.  By accessing and using the Website, Visitors warrant that they have read and accepted the current Privacy Policy, including any modifications. To the extent permitted by applicable law, Little Wren Farm’s use of personal information is governed by the Privacy Policy in effect at the time the personal information is collected.
